When Chatbots Cause Harm, Who Is Responsible?

AI chatbots have become part of daily life for hundreds of millions of people — answering questions, offering companionship, and helping with tasks. But a growing wave of lawsuits is forcing a fundamental legal question into the open: when an AI chatbot contributes to real-world harm, who is liable?

The answer is far from settled. Courts, lawmakers, and legal scholars are wrestling with how decades-old legal frameworks apply to technology that generates its own content, mimics human conversation, and operates through processes that even its creators cannot fully explain.

Is a Chatbot a Product or a Service?

Traditional product liability law holds manufacturers responsible when defective products injure consumers. Cars, pharmaceuticals, and children's toys all fall under this framework. But software has historically occupied a grey zone — often treated as a service rather than a tangible product.

That distinction is now shifting. In a landmark 2025 ruling, a federal judge in Orlando found that AI chatbot outputs qualify as a product rather than protected speech, allowing a wrongful death lawsuit against Character.AI and Google to proceed. The court rejected the companies' argument that their chatbot was merely hosting third-party content.

This matters because product liability opens three powerful legal avenues for plaintiffs: design defect (the product was inherently unsafe), failure to warn (users were not adequately informed of risks), and manufacturing defect (the specific unit deviated from its intended design).

The Section 230 Question

Section 230 of the Communications Decency Act has long shielded internet platforms from liability for content posted by users. Social media companies have relied on it for decades. But AI chatbots present a fundamentally different scenario: they generate content rather than merely hosting it.

Legal analysts at Moody's and the Center for Democracy and Technology have noted that when AI produces original responses — rather than republishing user content — it acts more like a speaker than a platform. This distinction could strip away Section 230 protections entirely.

Congress has taken notice. Bipartisan legislation has been proposed to explicitly exclude generative AI from Section 230 immunity, though no federal law has yet passed.

What Plaintiffs Are Arguing

Lawsuits against AI companies typically combine several legal theories. Plaintiffs allege that emotionally immersive conversational design, the absence of robust safety guardrails, and inadequate age-verification systems create unreasonable risks — particularly for vulnerable users such as adolescents.

According to analysis by K&L Gates, a leading law firm, plaintiffs increasingly argue that safer, feasible alternative designs existed but were not implemented — a core requirement for proving design defect under product liability law.

The "black box" problem complicates matters further. Because AI decision-making processes are often opaque even to their developers, assigning responsibility and proving causation is inherently difficult.

Who Pays — Developer, Deployer, or User?

Liability can fall on multiple parties across the AI supply chain:

  • Developers (e.g., OpenAI, Google) who build the underlying model
  • Deployers — companies that integrate AI into consumer-facing products
  • Component suppliers — courts have ruled that companies providing AI models to third parties can be held liable as "component part manufacturers"

This chain-of-liability approach mirrors how courts handle defective automobile parts or pharmaceutical ingredients, spreading responsibility across everyone involved in bringing the product to market.

Where the Law Is Heading

The legal landscape is evolving rapidly. Proposed federal legislation like the AI LEAD Act would create a specific cause of action against AI developers for product liability claims involving design defects and failure to warn. Several U.S. states are pursuing their own frameworks, with New York proposing legislation to establish explicit liability for chatbot developers and deployers.

The emerging consensus among legal experts is clear: AI that causes serious harm — especially to minors — is unlikely to remain fully shielded by existing liability protections. As courts continue to treat chatbots as products rather than passive platforms, AI companies face a future where safety guardrails are not just an ethical choice but a legal necessity.
