How Courts Treat Social Media as a Defective Product

When Software Becomes a Defective Product
For decades, product liability law governed the physical world—faulty car brakes, contaminated food, exploding batteries. If a manufacturer sold a dangerous product, courts could hold the company responsible. Now, that same legal framework is being applied to something far less tangible: social media platforms.
Courts across the United States are increasingly allowing lawsuits that treat apps like Instagram and YouTube not as neutral communication tools, but as engineered products whose design can be defective. The shift has opened a new front in the legal battle over tech accountability, with more than 10,000 individual cases and nearly 800 school district claims pending nationwide.
Three Theories of Liability
Product liability claims against social media companies generally rest on three legal theories, the same ones used against car manufacturers and pharmaceutical companies for generations.
Design Defect
Plaintiffs argue that features like infinite scroll, autoplay, push notifications, and algorithmic content curation were deliberately engineered to maximize screen time, especially among young users. Under the Restatement (Third) of Torts, a product has a design defect if a reasonable alternative design would have reduced the risk of harm. Plaintiffs contend that platforms could have built in time limits, friction points, or age-appropriate defaults—but chose engagement over safety.
Failure to Warn
These claims assert that companies knew their products posed psychological risks to children and adolescents—including depression, anxiety, and body dysmorphia—but failed to disclose those dangers to users or their parents. Unlike pharmaceuticals, which can rely on doctors as intermediaries for risk communication, social media apps are marketed directly to minors, leaving no buffer between the product and the vulnerable user.
Negligence
Broader negligence claims argue that platforms owed a duty of care to their youngest users and breached it by prioritizing engagement metrics over wellbeing. Internal company documents, revealed through discovery and whistleblower disclosures, have shown that some platforms conducted research identifying harms to teen mental health—and then chose not to act on the findings.
The Section 230 Problem—and How Plaintiffs Get Around It
Section 230 of the Communications Decency Act has long shielded platforms from liability for content posted by their users. Tech companies have argued this immunity extends to addiction-related claims as well.
Plaintiffs have found a critical distinction that courts are accepting: platform design is not the same as platform content. As the Ninth Circuit Court of Appeals ruled in Lemmon v. Snap, a negligent design claim targets decisions the company made when building its product—not editorial choices about third-party speech. Claims that target features like autoplay or recommendation algorithms, rather than specific posts or videos, can proceed outside Section 230's shield.
This design-versus-content distinction has become the legal fulcrum of the entire litigation wave. Claims seeking safer content moderation still implicate Section 230, but claims targeting standalone product features—the slot-machine mechanics of the interface itself—increasingly survive motions to dismiss.
The Bellwether Verdict
In March 2026, a Los Angeles jury delivered a landmark verdict in KGM v. Meta & YouTube, the first bellwether trial in MDL No. 3047. The jury found both Meta and Google negligent and liable on all counts, awarding $6 million in compensatory and punitive damages. It was the first time a jury concluded that social media apps should be treated as defective products for being engineered to exploit developing brains.
The plaintiff, identified only as KGM, testified that she began using YouTube at age six and Instagram at age nine, and that compulsive use contributed to depression, body dysmorphia, and suicidal ideation. TikTok and Snapchat settled their claims before trial.
Why It Matters Beyond One Case
The KGM verdict does not bind other courts, but as the first bellwether in a massive multidistrict litigation, it carries significant persuasive weight. Legal analysts have compared the moment to early tobacco litigation in the 1990s, when juries first held cigarette makers responsible for knowingly selling addictive products.
The implications extend well beyond social media. If courts broadly accept that software design choices can constitute product defects, the same framework could apply to AI systems, recommendation engines, gaming platforms, and any digital product whose design foreseeably causes harm. For tech companies, the message is clear: how you build your product now carries the same legal weight as what you put inside a bottle or behind a steering wheel.
