Prosecutor's Office Passes Case to Police

Slovak police have launched an investigation into a criminal complaint against Prime Minister Robert Fico, filed by the opposition Freedom and Solidarity (SaS) party, concerning his decision to halt emergency electricity supplies to Ukraine. The Bratislava Regional Prosecutor's Office forwarded the 15-page complaint to an investigator of the Slovak Police Force for further action.

Prosecutor's Office spokesperson Gabriela Kováčová confirmed that "the criminal complaint has been handed over to an investigator of the Police Force for further action." The police will now assess whether the described facts constitute a criminal offense, or reject the complaint.

Opposition Alleges Treason

SaS chairman Branislav Gröhling filed the criminal complaint, which was signed by more than 13,000 citizens. The complaint alleges suspicions of several criminal offenses:

  • Treason,
  • Abuse of power by a public official,
  • Inhumanity,
  • Terrorist attack,
  • Breach of duty in the management of entrusted property.

Gröhling claims that Fico's decision to halt emergency electricity assistance to Ukraine means that Slovakia has "sided with Russia" in its war against the sovereign country. Former Justice Minister Mária Kolíková pointed out that, in her opinion, the Prime Minister did not have the authority to make such a decision unilaterally, and expressed suspicion of coordination with a foreign power.

Fico Conditioned Aid on Druzhba Oil

The Prime Minister announced the suspension of emergency electricity supplies to Ukraine on February 23, 2026. He conditioned the decision on the resumption of Russian oil transit via the Druzhba pipeline, which Ukraine reportedly suspended due to alleged damage to infrastructure. The Slovak government disputes this argument, claiming that Kyiv has not provided evidence of the damage.

It is important to distinguish the scope of the measure. According to the Slovak transmission system operator SEPS, standard commercial electricity supplies to Ukraine continue to flow – only the so-called emergency assistance has been suspended. Analyst Alexander Duleba pointed out that electricity continues to flow through the ENTSO-E infrastructure, the European transmission system operator.

Ukrainian state energy operator Ukrenergo stated that the suspended supplies do not have a material impact on the stability of the Ukrainian energy grid, as the last request for emergency assistance came more than a month before Fico's decision.

Diplomatic Consequences for Slovakia

The case comes at a time of growing international pressure on Bratislava. Fico's foreign policy is increasingly straining relations with partners in the EU and NATO amid the ongoing conflict in Ukraine. Critics point out that using energy supplies as a political lever against an attacked neighbor damages Slovakia's credibility as a reliable ally.

However, legal experts point out that proving treason is extremely difficult in practice, especially if the government argues that it is protecting national interests. The police now have several options – to initiate criminal proceedings, to dismiss the case, or to reject the complaint. The outcome of the decision will have a fundamental impact on the further development of the political crisis in Slovakia.
